Official Rules

NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE CHANCE OF WINNING. Entry in this Contest constitutes acceptance of these Official Rules. Approximately $40,000.00 USD in total prizes.

  1. DESCRIPTION OF THE CONTEST. The Salute to Senior Service® Contest (“Contest”), sponsored by Home Instead, Inc. (“Sponsor”), is designed to give members of the public (“Nominators”) the opportunity to nominate a senior citizen age 65 years and older who volunteers a minimum of fifteen (15) hours per month (“Nominee”) for public recognition and the opportunity to designate a charity to which Sponsor will make a donation (as described below).

    Subject to the terms below, the public will select by online voting one Nominee from each U.S. state (and the District of Columbia) and Canadian province (excluding Quebec) (collectively, the “Local Salute to Senior Service Winners”) from which a panel of judges will, in turn, select one national Salute to Senior Service winner in each of the U.S. and Canada (collectively, the “National Salute to Senior Service Winners”). Sponsor will donate $500 to a 501(c) non-profit charity (or, in Canada, a comparable charity in good standing with the Canadian Revenue Agency) that is selected by each Local Salute to Senior Service Winner and is mutually agreeable to Sponsor, and feature the Local Salute to Senior Service Winners on the “Wall of Fame” on the Contest’s landing page at http://www.SalutetoSeniorService.com or http://www.SalutetoSeniorService.ca (each a “Landing Page” and, collectively, the “Landing Pages”). In addition, the National Salute to Senior Service Winners will each be eligible to select a 501(c) non-profit charity in good standing with the IRS (or, in Canada, a comparable charity in good standing with the Canadian Revenue Agency) that is mutually agreeable to Sponsor to receive a $5,000 donation from Sponsor.

  2. ELIGIBILITY. This Contest is only open to legal U.S. and Canadian residents (excluding residents of Quebec) who are 65 years of age or older as of March 1, 2014. Employees and directors of Sponsor, or of any Home Instead Senior Care® franchise office, and their respective subsidiaries and affiliated companies, advertising, promotion or production agencies, web masters and web suppliers (and their respective IRS dependents (for U.S. residents), immediate family members and individuals residing in the same household) are not eligible to participate. Void in Puerto Rico, Quebec and where prohibited.

  3. ENTRY PERIOD. This Contest begins at 12:00 a.m. Eastern Standard Time (EST) on January 15, 2014 and ends at 11:59 p.m. EST on March 1, 2014 (“Contest Period”).

  4. HOW TO ENTER.

    1. To enter this Contest, Nominators must complete and submit a Salute to Senior Service entry form (“Entry Form”). Nominators may obtain this Entry Form either online, at the Contest’s Landing Pages, or by requesting an Entry Form from a Home Instead Senior Care franchise office. To locate a Home Instead Senior Care franchise office, visit www.HomeInstead.com.

    2. Nominators may enter this Contest either electronically or by mail. All Entry Forms, whether submitted electronically or by mail, must be received by Sponsor no later than 11:59 p.m. EST on March 1, 2014 (the “Entry Deadline”).

    3. To electronically enter this Contest, Nominators must go to the applicable Landing Page and complete and timely submit an Entry Form.

    4. All mail-in Entry Forms must be:

      1. postmarked on a date which falls between the following dates: on or after January, 15, 2014 and on or before March 1, 2014
      2. mailed to either Salute to Senior Service, P.O. Box 285, Bellevue, NE 68005 (for US entries) or P.O. Box 25 Toronto F, Toronto, ON, M4Y 2L8 (for Canadian entries), and
      3. received by Sponsor by the Entry Deadline.
    5. Sponsor will not accept Entry Forms which are received after the Entry Deadline.

    6. Sponsor is not responsible for lost, late, illegible, incomplete, mutilated, misdirected, or stolen Entry Forms.

  5. ENTRY REQUIREMENTS.

    1. All Entry Forms must include the following information:

      1. The Nominator’s name, valid e-mail address and phone number.
      2. The Nominee’s name, city, state or province, phone number and age.
      3. The name of the organization(s) at which the Nominee volunteers, along with the length of service and the number of hours the Nominee volunteers on a monthly basis.
      4. A description of the Nominee’s volunteer activities and the reason(s) why the Nominator believes the Nominee is deserving of recognition. This description should include the following details:

        • How did the Nominee get involved in volunteering?
        • What does the Nominee enjoy about volunteering?
        • Who is impacted by the Nominee’s volunteer service?
        • What has the Nominee’s volunteer service accomplished?

        Nominators are welcome to share stories that illustrate their answers to the above questions.

      5. An acknowledgement that the Nominator has notified the Nominee of, and the Nominee has accepted, the nomination. To the extent that this acknowledgement is not provided or the Nominee rejects the nomination, the Entry Form will be disqualified from the Contest.

    2. Nominators may nominate themselves and/or as many Nominees as they like.

    3. Once submitted, all Entry Forms and any accompanying materials become the property of Sponsor and will not be returned to the Nominator.

    4. Sponsor reserves the right in its sole discretion to disqualify any Entry Form at any time for which, in Sponsor’s sole opinion, it is determined that the Nominator and/or Nominee is in violation of these Official Rules.

  6. SELECTION AND ANNOUNCEMENT OF WINNERS.

    1. Local Salute to Senior Service Winners.

      1. Sponsor will declare the individual from each state and province (excluding Quebec) whose qualified Entry Form receives the highest number of votes from the public on the applicable Landing Page and any websites of organizations which have received Sponsor’s permission to publicize this Contest as of the Entry Deadline (as automatically tallied by Sponsor), if any, the Local Salute to Senior Service Winner of the individual’s respective state or province. In the event of a tie, the Local Salute to Senior Service Winner will be chosen at random using a mechanism selected at Sponsor’s sole discretion. The odds of being declared a Local Salute to Senior Service Winner are dependent upon the number of eligible Entry Forms Sponsor receives for each state and province (excluding Quebec) and the total amount of votes each Entry Form receives from the public (as provided above) during the Voting Period (as defined below).

      2. The voting portion of the Contest is open to any legal U.S. resident within the 50 United states and the District of Columbia who is 18 years of age or older as of March 1, 2014, and any legal Canadian resident who is of or above the age of majority in his/her province or territory of residence as of March 1, 2014.

      3. Sponsor will only accept votes received between the following dates: at or after 12:00 a.m. EST on January 15, 2014 and on or before 11:59 p.m. EST on March 1, 2014 (the “Voting Period”). Only one vote per person per each day of the Voting Period will be allowed. If it is determined that an artificial vote inflation system was used at any point during this Contest to gain or submit additional votes, the affected Entry Form will be disqualified. Votes cannot be combined across multiple Entry Forms for the same individual; rather, the individual whose Entry Form receives the most amount of votes will be declared the Local Salute to Senior Service Winner.

    2. National Salute to Senior Service Winners. On or after April 7, 2014 and before April 11, 2014, Sponsor, along with a judging panel chosen by the Sponsor (the “Judging Panel”), will select the National Salute to Senior Service Winners from the Entry Forms of the Local Salute to Senior Service Winners (the Local Salute to Senior Service Winners and the National Salute to Senior Service Winners collectively referred to as the “Winners”). The Judging Panel will consist of five (5) judges from the U.S. (who will help Sponsor to determine the U.S. National Salute to Senior Service Winner) and five (5) judges from Canada (who will help Sponsor to determine the Canadian National Salute to Senior Service Winner). Sponsor and the Judging Panel will base their respective selection of the National Salute to Senior Service Winners on the following criteria:

      1. Does the Nominee volunteer at least fifteen (15) hours per month?

      2. Has the Nominee satisfied the eligibility criteria listed in section 2 above?

      3. How compelling is the Nominator’s reason(s) for believing that his or her Nominee deserves to be selected as a National Salute to Senior Service Winner?

      4. How compelling are the public’s comments (if any) posted on the Contest’s Landing Page and overall level of engagement with regard to the nomination? Sponsor and the Judging Panel will consider all public comments; provided, however, that they are received during the Voting Period. The Sponsor and the Judging Panel will not consider any public comments received after the Voting Period.

      5. Are there unique or special considerations that make one nomination more compelling than other nominations submitted?

      6. Did the Entry Form satisfy all of the other criteria listed in section 5 above?

      7. Are there any objective considerations as to why an Entry Form should not be included in the judging?

    3. Announcement of Winners. Local Salute to Senior Service Winners and the National Salute to Senior Service Winners will be announced on the “Wall of Fame” on the Contest’s Landing Pages by April 11, 2014; provided, however, that before being declared a Winner, each Winner shall comply with these Official Rules, sign and return all applicable documents (as further described in section 8 below) and, if a Canadian resident, be required as applicable to correctly answer, without assistance of any kind, a time-limited mathematical skill-testing question.

  7. AWARDS AND DONATIONS.

    1. Sponsor will donate $500 to a 501(c) non-profit charity (or, in Canada, a comparable charity in good standing with the Canadian Revenue Agency) that is selected by each Local Salute to Senior Service Winner and is mutually agreeable to Sponsor, and feature the Local Salute to Senior Service Winners on the “Wall of Fame” on the applicable Landing Page.

    2. Sponsor will also donate $5,000 to a 501(c) non-profit charity (or, in Canada, a comparable charity in good standing with the Canadian Revenue Agency) that is selected by each National Salute to Senior Service Winner and is mutually agreeable to Sponsor.

  8. RIGHTS AND PUBLICITY. By submitting an Entry Form and/or agreeing to a nomination, each Nominator and Nominee: (a) grant to the Sponsor the right to use their name(s), mailing address(es), telephone number(s), and e-mail address(es)(“Personal Information”) for the purpose of administering the Contest; (b) grant to the Sponsor the right to use their name(s), likeness(es), Entry Form, and any photograph or video for publicity and promotional purposes relating to this Contest or similar promotions, in any and all media now known or hereafter devised without further compensation unless prohibited by law; and (c) acknowledge that the Sponsor may disclose their Personal Information to third party agents and service providers of the Sponsor in connection with any of the activities listed in (a) and (b) above. The Sponsor will use the Personal Information only for these identified purposes, and protect the Personal Information in a manner that is consistent with the Sponsor’s privacy policy located at www.homeinstead.com. By submitting an Entry Form, the Nominator acknowledges, agrees, represents and warrants that: (a) he or she owns all content in the Entry Form submitted, has permission to use any material included in the Entry Form, and has permission from anyone referenced or featured in the Entry Form to use his or her name and/or likeness for publicity and promotional purposes relating to the Contest or similar promotions; (b) any stories the Nominator submits, and any copyright in the stories, shall be deemed to be the property of, and all right and title in the stories in the Nominator’s Entry Form and any copyrights therein are hereby assigned to Sponsor; (c) if it is determined that any of the stories in the Nominator’s Entry Form, or any part thereof, have not been assigned to Sponsor, the Nominator hereby grants Sponsor a perpetual, exclusive and royalty-free license to the stories in the Nominator’s Entry Form; and (d) nothing in the Entry Form violates any third person’s intellectual property, privacy or other rights. Should Sponsor reprint any content of the Nominator’s Entry Form, the Nominator acknowledges that this content may be adapted and rewritten to fit publication format. By submitting an Entry Form and/or accepting any nomination or award, each Nominator, Nominee and Winner agrees to and does hereby assign and transfer to Sponsor all right, title and interest in and to the Entry Form, including and not limited to the copyright and moral rights, worldwide, in the original winning Entry Form subject to reserving rights for the Nominator’s, Nominee’s and Winner’s private/non-commercial use only, allowing the Sponsor and those acting pursuant to Sponsor’s direction to use the Entry Form for advertising, trade, promotional or any purpose worldwide, and on the Internet or any medium, without review or approval by, or notification to, the Nominator, Nominee and/or Winner. Each Nominator, Nominee and Winner agrees to execute all documents deemed necessary by Sponsor to record and perfect any such assignment and transfer. All Winners will be required to complete, sign and return a Statement of Eligibility & Liability/Publicity Release (where legal) as a condition of being named a valid Winner and provide, by mail, a recent photo for publicity. The Statement of Eligibility & Liability/Publicity Release must be returned within five business days of Sponsor’s first attempted notification or the award will be forfeited.

  9. RESPONSIBILITY. By entering the Contest, each Nominator and Nominee accepts and agrees to these Official Rules and the final selection by the public, Sponsor and/or Judging Panel of the Winners as outlined in the terms above. By entering this Contest, each Nominator and Nominee agrees to indemnify and hold Sponsor and each Home Instead Senior Care® franchise office, and all of their respective directors, officers, employees, representatives, agents, assigns, subsidiary and affiliated companies, and advertising and promotion agencies harmless for any injuries, losses or damage of any kind, including death or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any award or donation or participating in this Contest or any Contest-related activity. Sponsor has not made and/or is not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, relative to any award or donation. All federal, state, provincial and local laws and regulations apply. Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors or failures of any kind, or delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part, should virus, bug, tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor’s control corrupt the administration, security, fairness or integrity of the Contest. Sponsor is not responsible for incorrect or inaccurate Entry Form information, whether caused by the Nominator or Nominee, administrator, any of the equipment or programming associated with or utilized in the Contest, or by technical or human errors, which may occur in the processing of the Entry Forms in the Contest. Proof of mailing is not proof of delivery. Neither Sponsor nor its agents are responsible for injury or damage to the Nominator’s or to another person’s computer related to or resulting from participating in this Contest. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the Entry Form submission process or the operation of the Contest or any Contest-related website, or to be acting in violation of the Official Rules. Sponsor reserves the right to modify, suspend or terminate this Contest, or change the rules of this Contest, if the Contest is unable to be run as planned, in Sponsor’s sole discretion. By entering this Contest, Nominators and Nominees agree that any and all disputes and claims arising out of or in connection with this Contest or any award or donation shall be resolved individually without resort to any form of class action, and that any claims, judgments and awards shall be limited to actual out of pocket costs incurred (and in no event attorneys’ fees), and under no circumstances will any Nominator or Nominee be permitted to obtain any award for punitive, incidental or consequential damages. In the event that any Nominee chooses to not accept his or her nomination or award, is not in compliance with the Official Rules, and/or is unable to be notified, the award and the donation will be forfeited and an alternate Winner may be randomly selected from all of the remaining qualified Entry Forms. In the event of any discrepancy or inconsistency between the terms and conditions of the Official Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest Entry Form, or point of sale, television, print or online advertising, the terms and conditions of the Official Rules shall prevail, govern and control.

  10. WINNER DISCLOSURE. To view the Winners, visit the Contest’s Landing Pages or mail a self-addressed stamped envelope after May 30, 2014 to Home Instead, Inc., Attn: Cat Koehler - Salute to Senior Service List, 13323 California Street, Omaha, NE 68154.

  11. SPONSOR. Home Instead, Inc., located at 13323 California Street, Omaha, NE 68154, is the franchisor of the Home Instead Senior Care franchise network of independently owned and operated franchise offices and is the Sponsor of, and is responsible for, this Contest. All participants acknowledge and agree that Sponsor shall be solely responsible for all awards and donations and shall not be liable for any act of omission arising out of, or related to, this Contest.
